Terms of Service
Rose Tech HQ LLC · LossFolio · Effective October 19, 2026
Everyone who visits lossfolio.com or uses a LossFolio account — company admins, their team members, and our partners.
If your company has accepted the Products Access & Services Agreement, that agreement controls pricing, refunds and data ownership, and wins any conflict.
Measurements, quotes, weather and code reports support your judgment. Verify them before you rely on them.
Your company owns its customer data. We use it only to provide LossFolio and never sell it.

1. Agreement to these Terms
These Terms of Service (the “Terms”) are a binding agreement between you and Rose Tech HQ LLC, a Wyoming limited liability company (“Rose Tech HQ LLC”, “we”, “us” or “our”), which operates the LossFolio website at lossfolio.com and the LossFolio platform, including its reports, tools, AI assistant and related services (together, the “Services”). By creating an account, signing in, or otherwise using the Services, you agree to these Terms and to our Privacy Policy and Acceptable Use Policy. If you do not agree, do not use the Services.
If you use the Services on behalf of a company or other organization, you confirm that you are authorized to bind it to these Terms, and “you” includes that organization. You must be at least 18 years old to use the Services. The Services are intended for businesses and their personnel, not for personal, family or household use.
2. Accounts and access
- Accounts are created by a company's administrator, by our team, or through self-serve signup. Keep your sign-in details confidential and use your own login — logins are personal and may not be shared.
- You are responsible for activity under your account. Tell us right away at security@rosetechhq.com if you believe your account has been used without permission.
- Company admins control who in their company has access and at what level, and are responsible for removing people who should no longer have access.
- Provide accurate, current information (including your company's contact details and billing address) and keep it up to date.
- To support you, authorized Rose Tech HQ LLC staff may view your account as you see it. Every such visit is logged with a reason, and your company admins can see those visits in their account's access log (see our Trust Center).
3. Business customers
A company that enrolls in LossFolio accepts the Products Access & Services Agreement (the “Customer Agreement”), which governs that company's pricing, payment, refunds, data ownership and related matters, and the Data Processing Addendum. If these Terms conflict with a company's Customer Agreement or Data Processing Addendum, those documents control for that company. Fees, charges and refunds are described in the Customer Agreement and our Refund & Cancellation Policy; each order shows its price before you confirm it.
4. Acceptable use
You must use the Services lawfully and in line with our Acceptable Use Policy. In short, do not: share or resell access outside your company; upload information you have no right to use; use the Services to deceive an insurance carrier, homeowner or anyone else; try to break, probe or overload the Services (except as allowed by our Vulnerability Disclosure & Bug Bounty policy); or copy, scrape or reverse engineer the Services.
5. Reports are estimates
Roof measurements (including measurements built from another tool's report or from photos, which are marked “estimated”), Fast Retail Quotes, Build Estimates, Scope of Work quotes, Xactimate ESX conversions, weather history, building-code and code-gap reports, and other outputs are estimates and informational tools. They are not guarantees of measurements, quantities, pricing, coverage, weather events, code requirements, claim outcomes or insurability, and they are not legal, insurance, engineering or public-adjusting advice. You are responsible for verifying outputs — including on site — before ordering materials, quoting a customer, or submitting anything to a carrier, and for complying with the laws and licensing rules that apply to your business.
6. AI features
Some features use artificial intelligence, including the in-app assistant, reading carrier estimates and measurement reports, reading photos to estimate roof pitch, and building-code gap analysis. AI output can be wrong or incomplete and must be reviewed by a person before you rely on it. The assistant will not place orders or charge your account on its own — you confirm every order. Content you submit to an AI feature is sent to our AI provider only to produce that output; our AI provider's commercial terms do not allow it to use that content to train its models. Do not submit information to the assistant that it does not need, such as full payment card numbers or government ID numbers.
7. Your content and data
As between you and us, your company owns the data it puts into the Services, including information about its customers (“Customer Data”). You grant us the rights needed to host, process, display and transmit Customer Data to provide, secure and support the Services, as described in the Customer Agreement, the Data Processing Addendum and our Privacy Policy. You are responsible for having the rights and any notices or consents needed to provide Customer Data to us — for example, your right to photograph a property and to share a homeowner's contact details. We may create aggregated, de-identified data from use of the Services to operate and improve them; it does not identify you, your company or your customers.
8. Third-party services and data
The Services rely on third-party providers and data sources — for example, payment processing by Stripe, maps and geocoding, aerial roof measurement providers, public weather records, and building-code publishers. Their availability and accuracy are outside our control, and your use of a third-party service may also be subject to its own terms. Our current providers are listed on our Subprocessors page. Xactimate and other product names are trademarks of their owners; LossFolio is not affiliated with or endorsed by them.
9. Our intellectual property
The Services — including software, report formats, rate tables, templates, designs, the LossFolio name and logo, and all related intellectual property — belong to Rose Tech HQ LLC or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for your company's internal business purposes while your account is in good standing. Reports delivered to you may be shared with your customers, carriers and others involved in the job.
10. Feedback
If you send us ideas or suggestions, we may use them without restriction or obligation to you.
11. Copyright complaints
If you believe content in the Services infringes your copyright, email service@rosetechhq.com with “Copyright notice” in the subject and include: your contact details; the work you believe is infringed; where the material appears in the Services; a statement that you have a good-faith belief the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner, with your physical or electronic signature. We may remove material and suspend repeat infringers.
12. Security research
Good-faith security research that follows our Vulnerability Disclosure & Bug Bounty policy is authorized, and we waive the parts of these Terms that would otherwise prohibit it, as described in that policy. Report issues to security@rosetechhq.com.
13. Suspension and termination
You may stop using the Services at any time. We may suspend or end access to the Services if you breach these Terms or the Customer Agreement, if payment is overdue as described in the Customer Agreement, if required by law, or if your use creates a security risk or could harm us, other users or third parties. Where reasonable, we will give notice first. Sections that by their nature should survive — including 5, 7, 9 and 14–19 — survive termination.
14. Disclaimers
EXCEPT AS EXPRESSLY STATED IN A WRITTEN AGREEMENT WITH US, THE SERVICES AND ALL REPORTS AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE AND NON-INFRINGEMENT, AND WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER ROSE TECH HQ LLC NOR ITS AFFILIATES, OFFICERS, EMPLOYEES OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS OR DATA, ARISING OUT OF OR RELATING TO THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE FEES YOUR COMPANY PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS. IF YOUR COMPANY HAS A CUSTOMER AGREEMENT, ITS LIMITATION OF LIABILITY APPLIES INSTEAD. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
16. Indemnification
You will defend and indemnify Rose Tech HQ LLC against third-party claims, losses and reasonable costs (including attorneys' fees) arising from your Customer Data, your misuse of the Services, or your violation of these Terms or of law — for example, a claim arising from a quote or estimate you gave your customer or a carrier without verifying it.
17. Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws rules. Before bringing a claim, contact us at service@rosetechhq.com and give us 30 days to try to resolve it informally. Any dispute that is not resolved will be finally resolved by binding arbitration seated in New Jersey under the commercial arbitration rules of a recognized arbitration provider, on an individual basis — not as a class, collective or representative action. Either party may bring an individual claim in small-claims court, or seek injunctive relief in the state or federal courts located in New Jersey to protect confidential information or intellectual property. If your company has a Customer Agreement, its dispute-resolution section controls.
18. Changes to these Terms
We may update these Terms. We will post the new version here with a new effective date and, for material changes, notify account administrators by email or in the app at least 30 days before they take effect, unless a change is required sooner by law or to address a security issue. Continuing to use the Services after a change takes effect means you accept it.
19. General
These Terms, together with the documents they reference, are the entire agreement between you and us about the Services, and replace earlier understandings on that subject. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. Notices to you may be sent to your account email; notices to us must be sent to service@rosetechhq.com.
